These terms and conditions of sale are the terms and conditions on which we supply any of the products listed on our website, www.petit-bateau.gr, to you. Please read these terms and conditions carefully before ordering any products from our site. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions.
We reserve the right to make changes to these terms and conditions of sale at any time by publishing a new version on our website. Our applicable terms and conditions of sale are those published on this web page at the time you place your order.
1 . INTRODUCTION
1.1 We own and operate the retail website www.petit-bateau.gr ("Website"). Any reference in these terms and conditions to "Petit Bateau", "we", "us" or "our" is a reference to BRANDSMANAGEMENT LTD AND CO EE, a company registered in Greece under General Commercial Register company number (Γ.Ε.ΜΗ.): 6065801000 and its registered office at 15 SAPFOUS STREET, TK 11146 GALATSI, ATHENS, GREECE. Our VAT number is 999798894.
1.2 Through this Website BRANDSMANAGEMENT LTD AND CO EE makes available to you various textile products, babycare products and accessories made by or on behalf of Petit Bateau and our commercial partners (the "Products") to online web users ("Customer", "you" or "your"). For the purposes of these terms and conditions, the Customer and BRANDSMANAGEMENT LTD AND CO EE will be collectively referred to as "Parties".
2 . SERVICE AVAILABILITY
2.1 Products are sold to private individuals for the Customer’s personal and not professional use. BRANDSMANAGEMENT LTD AND CO EE reserves the right to cancel any order which in its opinion is excessive or not for personal use.
2.2 The Website is only intended for use by people resident in Greece ("Territory"). We do not accept orders from individuals outside the Territory.
3 . PRODUCT AVAILABILITY
3.1 Only the Products currently displayed on the Website are offered for sale (subject to stock availability).
3.2 Photographs of Products on the Website are for indicative purposes only and shall not be relied on by the Customer in any way. The Customer is required to read the description of each Product to be aware of specific details relating to the Product.
4 . PRICES
4.1 All prices are displayed in Euro and are inclusive of VAT.
4.2 The price of the Products and our delivery charges will be as quoted on the Website at the time of placing an order, except in cases of obvious error.
4.3 The flat-rate delivery charge will be added at order summary stage prior to the Customer clicking on the submit order button.
5 . ORDERS
5.1 You may place an order by selecting the Product and clicking on the "Add to basket" button.
5.2 You may do the following at any time:
a) check the number of Products in the basket and get detailed info on each Product by clicking on the "My basket" button
b) continue adding Products by clicking on "Continue shopping" button
c) complete the order by clicking on the "Submit basket" button.
5.3 All new Customers are required to complete the necessary fields to create a Customer account. You must complete the required form which will include key information to identify yourself, a valid email address and password of choice (personal and confidential to you), all of which will serve to confirm your identity on the Website in the future.
5.4 All Customers with an account will be required to confirm their identity after clicking on the "Order" button by confirming their email address and password. Any order placed using your email address and password will be deemed to have been made by you and you will be responsible for any such order made. We therefore recommend keeping such email address and password private and confidential at all times.
5.5 You acknowledge and agree to providing the information requested to us for the purposes of:
a) proving your identity
b) to process and deliver your order
c) Invoicing you for the order
5.6 You are required to double check your order is correct and that all required information has been entered as appropriate, including:
a) invoice address
b) delivery address
c) order summary (type, quantity and price of Products)
d) total cost of the order
e) a gift option (Products gift-boxed)
f) delivery costs
5.7 To progress onto the next stage (choice of payment method), you must tick the box confirming that you have read and accepted these terms and conditions of sale.
5.8 Once you have double-checked your order summary, you need to click on the "confirm and proceed to payment" button to confirm the order.
5.9 By submitting an order summary you confirm and agree to be bound by these terms and conditions of sale and the information set out in the order summary. Your order constitutes an offer to buy a Product from BRANDSMANAGEMENT LTD AND CO EE and will be subject to acceptance by BRANDSMANAGEMENT LTD AND CO EE in accordance with condition 7 below.
5.10 BRANDSMANAGEMENT LTD AND CO EE reserves the right to refuse an order if:
a) it considers the order to be excessive or not for personal use as described in condition 2 above
b) there is any ongoing dispute/s with the Customer
c) there has been total or partial non payment of a previous order placed by the Customer
d) the bank has declined the bank card payment submitted by the Customer
e) in BRANDSMANAGEMENT LTD AND CO EE’s opinion there is any other legitimate reason (including but not limited to the non-availability of the Product/s, the order being abnormal or unusual or any lack of good faith on the part of the Customer).
6 . PAYMENT
6.1 The sum due for payment by you is the total amount shown on the order summary that you checked prior to pressing the "Submit" button to validate your order. The price is repeated again once payment has been made in the order summary email sent to you by BRANDSMANAGEMENT LTD AND CO EE.
6.2 We accept the following forms of payment: credit/debit cards: Visa, Mastercard, Maestro and PayPal
6.4 All card payments are subject to authorisation by your card issuer and your card will not be debited until the order preparation is finalised.
6.5 As part of preventing fraud, BRANDSMANAGEMENT LTD AND CO EE has added an extra level of security for Visa and MasterCard payments, which protects you from the unauthorized use of your credit card. 3-D Secure technology consists of the programs Verified by Visa and MasterCard SecureCode. This authentification payment system will strength the security with your online purchase.
After you enter your credit card details in our online store, a new window will appear, requesting your personal security code. Your financial institution will authenticate the transaction within seconds, as well as confirm that you are the individual making the purchase.
If you haven't yet registered with Verified by Visa or MasterCard SecureCode, you'll need to activate this feature first. You can do this during the payment process, or activate it in advance through the Visa or MasterCard website. Please make sure that you can receive the 3D Secure authentification text message.
After you register, you can use the security code for all your online transactions. More and more online stores are making this extra security code compulsory.
REMINDER, your transaction will be cancelled after 3 authentification failure . in that case please contact your Bank.
7 . ORDER CONFIRMATION
7.1 Once the Product is ready for dispatch we will take payment and send you an email summarising the order details and confirming that the Product has been dispatched ("Dispatch Confirmation")
7.2 The contract between you and BRANDSMANAGEMENT LTD AND CO EE ("Contract") is formed when we send you the Dispatch Confirmation.
7.3 The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
7.4 You will be notified of the unavailability of any Product on an e-invoice corresponding to the order placed. You will receive this e-invoice via your email address no later than 5 days after despatch of Products.
8 . DELIVERY TIMING
8.1 BRANDSMANAGEMENT LTD AND CO EE will use reasonable endeavours to ensure that orders are processed within a 48 hour period but we cannot be held responsible for delays due to weather or other circumstances beyond our control. In these cases we will process the order as soon as is reasonably possible.
8.2 Orders placed on the Petit Bateau Website on Friday afternoon, Saturday or Sunday are processed on the following Monday. Orders placed on the Petit Bateau Website on a public holiday that falls on any day other than Friday, Saturday or Sunday will also be processed the following working day.
8.3 Delivery cannot be guaranteed in cases of force majeure as outlined under condition 18 below.
9 . HOME DELIVERY
9.1 Products ordered by you are delivered to the delivery address provided and confirmed by you in the order summary. Deliveries will only be made to addresses in the Territory. Delivered goods are accompanied by a delivery note that includes details of handling/delivery charges. You also have the option of having Products delivered to an address other than your home address provided the address is within the Territory.
9.2 BRANDSMANAGEMENT LTD AND CO EE will do its very best to ensure that your order is delivered within a minimum 2 days to 5 days from the day after payment has been made for said order.
9.3 BRANDSMANAGEMENT LTD AND CO EE shall not be liable to you for any delay howsoever caused by persons for which we are not directly responsible for example as a result of any postal delay or strikes.
10 . RECEIPT OF ORDER
10.1 You have the right to order the products of your choice from our Website and get them from our stores.
10.2 You have the right to order the products of your choice from our Website and choose to pay by cash on delivery.
10.3 The Products will be your responsibility from the time of delivery.
10.4 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
10.5 When you receive your order, you must check that Products received are in conformance with your order. BRANDSMANAGEMENT LTD AND CO EE’s customer services should be notified of any problems regarding delivery (i.e. missing items, damaged items and damaged packaging etc) within 15 days from receipt of Products.
10.6 You may contact customer services by:

10.7 Subject to any other legal rights you may have, BRANDSMANAGEMENT LTD AND CO EE shall have no liability or obligation to you in respect of any complaint made after 15 days from delivery of the Products.
10.8 BRANDSMANAGEMENT LTD AND CO EE reserves the right to ask you to return any Product that you claim does not correspond to your order or which has been damaged.
11 . RIGHT TO CANCEL ORDER
11.1 You have the legal right under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order without a reason. To cancel your order you must give BRANDSMANAGEMENT LTD AND CO EE’s customer services team written notice that you wish to cancel the order no later than seven (7) working days from the date you received the Product(s).
11.2 BRANDSMANAGEMENT LTD AND CO EE will refund to you the total cost of the Products within thirty (30) days from the date it receives your cancellation notice, less any cost of returning the Products, which remains the responsibility of the Customer.
11.3 You are under a duty to take reasonable care of the Products. You must return the Product(s) (using appropriate and suitable packaging to protect the Products during delivery) at your own expense to BRANDSMANAGEMENT LTD AND CO EE CUSTOMER SERVICES DEPARTMENT, 37A KIFISIAS AVENUE, TK 15123 MAROUSI, ATHENS, GREECE.
12 . WARRANTY AND LEGAL RIGHTS
12.1 We warrant that any Product purchased from us through the Website will, on delivery, conform in all material respects with its description, be of satisfactory quality and be reasonably fit for all the purposes for which the Product is commonly supplied. Please note that we cannot and do not make any warranty and hereby exclude any liability in connection with the use of the Product in connection with any unusual or non-recommended use of the Product.
12.2 You have certain rights as a consumer, including legal rights relating to faulty or mis-described goods. Nothing in these terms and conditions of sale will affect these legal rights. If you would like information about your legal rights you should contact your local authority trading standards department or citizens’ advice bureau.
13 . EXCHANGES AND REFUNDS
31 IN-STORE EXCHANGES
You may, within twenty days of receipt of the Products, go to our Petit Bateau boutique to exchange a Product. Only Products that are unworn, unwashed and in their original packaging can be considered suitable for exchange. An exchange will require the presentation of the appropriate delivery slip or invoice.
13.2 REFUNDS VIA THE WEBSITE
You can return the products you have selected, if you have changed your mind or if the size does not fit you, or you made a selection that does not meet your expectations or the product is defective. BRANDSMANAGEMENT LTD AND CO EE tries not to ship products that do not meet the quality standards of our company.
In order to avoid the cost of return, please also consider other options before returning the products like using them as a gift for someone you love.
You have twenty (20) days to return, at your cost, any Product(s) which you have ordered if you are not satisfied with the Product/s. The 20 day time limit starts on the day the Products were delivered to the delivery address Product/s must be returned in their original condition and packaging and must be unworn, unwashed to the following address: BRANDSMANAGEMENT LTD AND CO EE CUSTOMER SERVICES DEPARTMENT, 37A KIFISIAS AVENUE, TK 15123 MAROUSI, ATHENS, GREECE, accompanied by a return slip (available for information purposes and to print from the Website under My Orders) or the return ticket number (attributed by our Website under My Orders).
Once we have reviewed your refund request we will send you a confirmation E-mail.
Should the above conditions be complied with, BRANDSMANAGEMENT LTD AND CO EE agrees to refund the Customer at the earliest opportunity.
You acknowledge and agree that some Products cannot be exchanged or refunded.
If you buy a set of products as a pack (pack of underwear, newborn gift set…), only the complete set of items will be possible to exchange or refund. The pack cannot be divided. An exchange or return of one or several products of the set will be refused.
In case of purchase with a debit or credit card or pay pal we credit your debit or credit card or pay pal account with the value of the products and the costs of delivery as soon as they are received and approved.
In the case of products which have been purchased with payment by cash on delivery, refund will be made through a bank deposit in the customer's account. Therefore we kindly ask you to inform us by email about your account number (IBAN), the bank maintaining the account and the recipient's name as given in the booklet. For security reasons, the account holder must be the same person on your sales receipt for the product that you have returned to us.
The sum of your refund will not include the possible return costs unless the return of the product is due to the fault of BRANDSMANAGEMENT LTD AND CO EE.
If you have received defective or damaged products, please contact us and we will arrange the return from you, as well as a full refund for the products. Upon acceptance of the product we will refund your money in the ways listed above, including shipping costs and we will arrange the return of the defective product.
From time to time, there might be a delay in crediting your debit or credit card that can be attributed to the bank. Please contact us if you have not received your credit within 20 days.
14 . PERSONAL INFORMATION
14.2 We respect your right to privacy and will only process personal data you provide to us in accordance with the Data Protection Act 1998, the Privacy and Electronic Communications (EC Directive) Regulations 2003 and other applicable privacy laws.
15 . FORCE MAJEURE
15.1 BRANDSMANAGEMENT LTD AND CO EE is not liable for any delay or non performance of its contractual obligations relating to our Contract with you if such failure or delay results from any circumstance or event beyond BRANDSMANAGEMENT LTD AND CO EE’s reasonable control (a Force Majeure Event) including but not limited to:
a) a total or partial disruption or strike affecting, in particular, the postal services or means of transport and/or communication
b) any default of our suppliers or sub-contractors
c) fire, explosion or other catastrophes
d) any denial of use of any railway, motorway, port, airport or other means of transport for any reason
e) breakdown of plant machinery, computers or vehicles
f) war, threat of war, armed conflicts, rebellion, sabotage or riots, acts of terrorism and actions by civil or military authorities resulting from such acts, civil commotion
g) extreme adverse weather conditions including flood, earthquake, snow, windstorm or other natural disasters or acts of God.
15.2 BRANDSMANAGEMENT LTD AND CO EE will notify you in the event of a Force Majeure Event within 5 working days of its occurrence and shall be relieved of its obligations to you until the applicable Force Majeure Event is over.
15.3 If the Force Majeure Event affecting BRANDSMANAGEMENT LTD AND CO EE continues for over thirty (30) days, both Parties shall be excused from their contractual obligations towards each other and where appropriate BRANDSMANAGEMENT LTD AND CO EE will refund you at the earliest opportunity.
16 . ENTIRE AGREEMENT
All services provided to you by BRANDSMANAGEMENT LTD AND CO EE are subject to these terms and conditions together with any previous written or oral representations given or made by BRANDSMANAGEMENT LTD AND CO EE or any representatives of BRANDSMANAGEMENT LTD AND CO EE. Neither BRANDSMANAGEMENT LTD AND CO EE nor you may alter the terms of this agreement without the consent of the other.
17 . LAW AND JURISDICTION
17.1 Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by Greek law.
17.2 Any dispute or claim arising out of or in connection with a Contract or its subject matter or formation (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of Greece.
PETIT BATEAU OUTLET TERMS AND CONDITIONS
For the Petit Bateau outlet, these special conditions prevail over the general conditions. These special conditions are applicable to the sale of the products on the site (www.petit-bateau.gr) under the outlet section. The Petit Bateau outlet products are available for a short, limited time only, during which the products of previous seasons are available in limited quantities, within the limits of available stocks. Outlet products cannot be exchanged or refunded in stores. Returns of outlet purchases must be returned unworn, unwashed and with the tags still attached to BRANDSMANAGEMENT LTD AND CO EE CUSTOMER SERVICES DEPARTMENT, 37A KIFISIAS AVENUE, TK 15123 MAROUSI, ATHENS, GREECE.
